Ms. Naghma Tabassum ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court at Barrackpore to dispose of the Title Suit No.357 of 2016 expeditiously. From the order sheets appended to this application this Court finds that an application under Order VI Rule 17 of the Code of Civil Procedure is pending and hearing of the same has been fixed on September 23, 2026. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2826 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court at Barrackpore to take up the hearing of the application under Order VI Rule 17 of the Code of the Civil Procedure filed by the petitioner on the next date fixed i.e. 2 September 23, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the said application as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the said application as well as any other interlocutory applications that may be pending, the learned trial judge shall make an endeavour to dispose of Title Suit No.357 of 2016 as expeditiously as possible keeping in mind that the suit is pending from the year 2016.
