Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused and the subject matter of the present case relates to alleged recovery of 100 bottles of Fairdyl Cough Syrup. Charge sheet has already been submitted according to the petitioner. As such, petitioner be released on bail.
Learned advocate for the State opposes the prayer for bail.
The memo of evidence did not reflect that there are any antecedents so far as the present petitioner is concerned.

Having considered the same, I am of the view that as charge sheet has been submitted and the prosecution has relied upon 17 witnesses in order to prove its case, the trial would take some time to be taken to its logical conclusion.
As such, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Pintu Mahanta @ Sarkar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1693 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
