This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court at Baruipur, South 24-Parganas to dispose of the application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure filed in Title Suit No.502 of 2022 expeditiously. Mr. Sanyal,learned advocate appearing for the petitioner submits that the injunction application is otherwise ready for hearing and is pending for a long time. From the order sheets appended to this application this Court finds that August 18, 2026 is fixed for hearing of the application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge.

In the light of the submissions made by the learned advocate for the petitioner, CO 2418 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court at Baruipur, South 24-Parganas to take up the hearing of the application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure on the next date fixed i.e. on August 18, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of 12 weeks from the next date fixed without granting any unnecessary adjournments to either of the parties. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
