1. By the present writ petition, the petitioner is seeking a direction towards the respondents authorities to consider and decide the petitioner’s appeal dated 01/07/2026 Annexure P-10.
2.
Learned counsel for the petitioner submits that the petitioner, posted as Veterinary Assistant Surgeon at Government Poultry Farm, Durg, availed leave on 24.03.2026 due to his father’s ill health. On the same date, the Director handed over the Farm’s managerial and financial/administrative charge to Respondent No.6. Though the Petitioner rejoined on 08.04.2026, the charge was not handed back to him despite his request and the Deputy Director’s recommendation. Thereafter, an inquiry committee, including Respondent No.6, was constituted regarding excess rearing of birds. Based on the inquiry, the Petitioner was suspended on 02.06.2026 without show-cause notice or hearing. Thereafter, the petitioner challenged the suspension order in W.P. (S.) No.4575/2026, but pursuant to the order of this Court dated 19.06.2026, withdrew the petition and filed an appeal under Rule 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 on 01.07.2026, the same has not yet been decided till date. Hence, the petitioner prays that the respondents may be directed to consider and decide the appeal filed by the petitioner.
3.
Learned counsel for the State would submit that if the appeal filed by the petitioner is still pending consideration, the same shall be considered and decided in accordance with law, within a period of
3 30 days.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Considering the limited prayer made by learned counsel for the petitioner and taking into account the submissions made by learned State counsel, this writ petition is disposed of with a direction to the respondent authorities to consider and decide the petitioner’s appeal dated 01/07/2026 Annexure P-10 in accordance with law, preferably within a period of 30 days from the date of receipt of a copy of this order.
6. With the aforesaid direction, the writ petition stands disposed of. SD/- (Bibhu Datta Guru)
