Amit Das & Anr. Versus The State of West Bengal
Ms. Minoti Gomes. …for the petitioners.
Mr. Krishnendu Bhattacharjee Mr. Somnath Bera. …for the State.
Mr. Susnigdho Bhattacharyya Mr. Suvam Paul. …for the de facto complainant.
Petitioners have been implicated on the accusations of allegedly assaulting the deceased. Both the petitioners are brothers and it has been alleged that with the daughter of the petitioner no.1, there was a relationship with the deceased which was the main reason for assaulting the deceased, Barun Das.
Learned advocate for the State has produced the case diary.
I have taken into account the post-mortem report. Although the death in the present case is because of poisoning but
2 there were number of injuries on the person of the deceased. The parents have complained that the deceased was assaulted and rang up his brother-in-law and subsequently events followed.
Having considered that the present is a case of anticipatory bail considering the facts which have surfaced, I am not inclined to extend the relief prayed for.
Accordingly, the application for anticipatory bail in CRM(A)1680 of 2026 is dismissed.
Case diary be returned to the learned advocate appearing for the State.
