Mr. Bhaskar Prosad Banerjee Mr. Aniket Mitra Mrs. Anupurba Banerjee Ms. Shalini Ghosh …for the petitioner Mr. Amajit De …for the CBI The petitioner who is the unfortunate father of the victim who faced death under mysterious circumstance at the age of twenty-one years on September 02, 2012 seeks transfer of Case No. RC1(S)/2019-CBI,SCB,Kolkata dated May 29, 2019 pending before the learned Chief Judicial Magistrate, Burdwan to the learned Chief Judicial Magistrate, Calcutta. Learned counsel for the petitioner submits that the case was initially investigated by the State and subsequently transferred to the CID and then to the CBI for investigation. Closure report was submitted by the CBI upon completion of investigation on December 11, 2020. Narazi petition has been filed by the petitioner against such closure which is pending. The petitioner has alleged non-cooperation by the department of the learned trial Court in providing certified copies of documents and other material related to the case. Also, the petitioner is septuagenarian person and a resident of Kolkata and finds it difficult to travel to Burdwan to attend the Court proceedings regularly. Learned counsel for the CBI submits, on instruction, that the matter be left to the discretion of the Court and the respondent has no comments to offer. This Court is also informed that a connected case being RC1(S)/2018-CBI,SCB,Kolkata dated June 14, 2018 (G.R.Case No. 580 of 2009) has been transferred by this Court to the City Sessions Court, Calcutta and is pending before the learned Chief Judicial Magistrate, Calcutta. In view of the fact that the CBI has no objection if the case is transferred to the learned City Sessions Court, Calcutta and also taking into consideration the age of the petitioner and the difficulties faced by him as recorded hereinabove, this Court is inclined to allow the petitioner’s prayer. The revisional application is accordingly allowed. Case No. RC1(S)/2019-CBI,SCB,Kolkata dated May 29, 2019 pending before the learned Chief Judicial Magistrate, Burdwan be transferred to the learned Chief Judicial Magistrate, Calcutta for disposal. The learned Chief Judicial Magistrate, Calcutta shall either deal with the case himself or assign the same to any other learned Judicial Magistrate within his jurisdiction for disposal. The learned Chief Judicial Magistrate, Burdwan is directed to transmit the case record alongwith relevant documents to the 2 learned Chief Judicial Magistrate, Calcutta within 10 days from the date of communication of this order. There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh,J) 3
