19.08.2026 Court No.35. D/L. 11. Kausik (Rejected) CRM (M) 1694 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bowbazar Police Station Case No. 211 of 2023 dated 18.10.2023 under Sections 120B/498A/302/304B/201 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act. And In the matter of : Indira Tiwari ……Petitioner. Mr. Satadru Lahiri Mr. Poulam Dey Mr. Syed Wasim Faruque ……for the Petitioner. Mr. Jayanta Narayan Chatterjee, Sr. Adv. Ms. Jayashree Patra ….for the defacto complainant. Mr. Pradeep Kumar Singh Mr. Ayon subhra Bandyopadhyay ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years and 9 months. She is the mother-in-law and was staying at the upper floor. She has been falsely implicated in connection with the instant case. However, the prosecution case has not progressed and there is no possibility of the trial being concluded in near future. Learned advocate for the defacto complainant opposes the prayer for bail. 2 State has produced the case diary. I have taken into account the post-mortem report and the Chemical Examiner’s Report which prima facie supports the prosecution case of a heinous murder. Having considered the same, I am of the opinion that this is not a fit case for granting bail in spite of the fact that the petitioner has suffered custody. Accordingly, CRM (M) 1694 of 2026 is dismissed. Case diary be returned to the learned advocate for the State. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
