Learned counsel for the petitioner submits that this Writ Petition has been preferred against the inaction on the part of Collector, District Raigarh C.G. in not deciding the petitioner’s application for cancellation of forged patta issued in favour of Respondent No.5. 2. Learned counsel for the petitioner submits that petitioners are landless persons who are living below poverty line and as such, petitioners are in possession of the government land for which they also pay fine to the competent authority. He submits that petitioner Nos.1 to 3 have constructed temporary house over the land bearing Khasra No.1123 and petitioners No.4 & 5 have constructed temporary house over the land bearing khasra No.309, situated within Gram Panchayat Amlitikra, Tehsil Dharamjaigarh, District Raigarh C.G. 3. Counsel for the petitioner further submits that the aforesaid land bearing Khasra No.309 & 1123 admeasuring area 0.7300 & 2.0230 respectively are recorded in the name of Government of Chhattisgarh and there being possession of petitioners on the said land, Respondent No.5 has obtained forged and fabricated patta in respect of aforesaid land. In this regard, petitioners have moved an application dated 03.08.2026 before Collector, Raigarh which is pending for consideration, as such, this petition for necessary direction to Collector, Raigarh. 4. In view of the submissions made by learned counsel for the petitioners and considering the limited relief sought, the present writ petition is disposed of with a direction to the Collector, Raigarh, to consider and decide the petitioners' application dated 03.08.2026, in accordance with law, by passing 3 a reasoned and speaking order, preferably within a period of 60 days from the date of receipt of a copy of this order. 5. It is made clear that this Court has not expressed any opinion on the merits of the claim of either party, and the competent authority shall take a decision strictly in accordance with law.
