1. The present writ petition has been filed under Article 226 of the Constitution of India seeking a limited direction to Respondent No.4/learned Tehsildar, Ratanpur, District Bilaspur (C.G.), for expeditious disposal of Case No.
202607072300043. 2. Learned counsel for the petitioner submits that the Petitioner, Krishna Kumar Agarwal, is the lawful owner and peaceful possessor of land bearing Khasra AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.09.02 11:18:45 +0530
2 No. 604/117, admeasuring 0.0067 hectare, situated at Village Ratanpur, Tehsil Ratanpur, District Bilaspur (C.G.), purchased through a duly registered sale deed from Kamta Prasad. The Petitioner commenced construction of his residential house upon his own land, without encroaching upon any public road, drainage or nistari land. Respondent No.5, Manoj Kumar Tekwani, objected before the Tehsildar, Ratanpur, alleging that the Petitioner was constructing over an alleged 30-feet drainage/nistari pathway situated near his land bearing Khasra No. 604/65. On the basis of the said objection, Case No. 202607072300043 was registered before the learned Tehsildar, Ratanpur, who, vide order dated 06.02.2026, called for a report from the Halka Patwari and directed stoppage of the Petitioner's construction pending further proceedings. He submits that construction by the petitioner has been stopped over his own land which is causing hardship to the petitioner, therefore, suitable direction may be issued to Tehsildar for expeditious disposal of the pending case. 3. Learned State counsel submits it is not clear as to whether the case has been decided or the same is pending, therefore, direction may issued to the Tehsildar who will decide the case of the petitioner, if not yet decided. 4.
In view of the submissions made by learned counsel for the parties, the present petition is disposed of with a direction to Respondent No.4/learned Tehsildar, Ratanpur, District Bilaspur (C.G.), to ascertain the status of Case No. 202607072300043 and, if the same is still pending, to decide the said case on its own merits, in accordance with law, preferably within a period of 30 days from the date of receipt of a copy of this order, after affording due opportunity of hearing to all concerned parties. 3
