3. After arguments at some length, learned counsel for the respondent placed the correct legal position before the Court by citing the judgment of the Hon’ble High Court of Judicature at Allahabad in Jagdish Narayan Tandon & Others v. Onkar Nath Tandon & Others.

Learned counsel for the revisionist seeks permission to withdraw the revision with liberty to file a writ petition under Article 227 of the Constitution of India. The said prayer is not opposed by learned counsel for the respondent.
5. In view of the above, learned counsel for the revisionist is permitted to withdraw the revision with liberty to file a writ petition as aforesaid.
6. The revision is, accordingly, dismissed as withdrawn with such liberty.
7. On the request of learned counsel for the revisionist, the Registry is directed to return the certified copy of the impugned order after retaining a photocopy of the same on record.
