Learned advocate appearing for the petitioner submits that petitioner has been implicated as there has been recovery of 192.9 Kgs. of Ganja from two vehicles and is in custody from
12.05.2025. Although, charge sheet has been submitted but till date charges have not been framed.
Learned advocate for the State opposes the prayer for bail since the seizure was from the conscious possession of the present petitioner. An order dated 10.07.2026 has been produced before this Court. The order reflects no witness is present and execution return regarding warrant of arrest.
Having considered the same, I direct the learned Trial Court to split up the trial if required and exhaust the process of
2 law. The seizure list witnesses may be examined within a reasonable period of time.
Petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses is over.
Accordingly, CRM (NDPS) 1352 of 2026 is dismissed at this stage.
