In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sahardighi Police Station Case No. 1000 of 2025 dated 15.12.2025 under Sections 316(2)/318(2)/318(4)/111(2)(b) of BNS, 2023.
And In the matter of : Amit Hasan
……Petitioner.
Ms. Sonali Das
……for the Petitioner.
Mr. Krishnendu Bhattacharya, APP
Mr. Sankalpa Bhattacharya
….for the State.
Learned advocate appearing for the petitioner submits that he is innocent. The only allegation against him is that he had been threatening.
Be that as it may, I find the crux of the case is that citizens were allured to part with money on the garb of doubling the investment.
Having considered the nature of the case and there is no Reserve Bank of India licence for carrying out such acceptance of funds from the public at large, I am of the opinion that this is not a fit case for anticipatory bail.
