This is second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 33/2026 registered at Police Station Chakradharnagar, District Raigarh (CG) for the offences under Sections 3,4,5, 5(1)(d)(ii) of the Immoral Traffic (Prevention) Act, 1956 and Section 4 of the POCSO Act, 2012. 2. The first bail application was rejected by order dated 14.05.2026 passed in MCRC No.3826 of 2026. 3. There are 3 victims and 2 accused in this case. Learned counsel for the applicant submits that out of 3 victims, one is minor girl and the other two ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.09.01 10:14:48 +0530 2 are majors ladies. As per the prosecution case, on information being received on 01.02.2026 the Police raided the residence of one Santosh ‘Soni in Kelo Vihar Colony, P.S. Chakradhar Natgar District Raigarh, During the raid, co-accused Nagendra was found in a room with a woman. The investigation revealed that the applicant Dimpy Ijardar, a tenant of the house of Santosh Soni, allegedly used the premises to run brothel activities, bringing women there for prostitution. Subsequently , FIR was registered for the said offence and the applicant was arrested on 02.02.2026. 4. Learned counsel for the applicant submits that though the applicant was residing as a tenant in the house of one Santoshi Soni, but he was not present and caught on the spot. He submits that the minor victim as also the other two victims in their court statements have turned hostile to the prosecution case. It is further submitted that till date, out of total 13 witnesses, only 7 have been examined; the applicant is in jail since 02.02.2026 and there is no immediate possibility of disposal of case, and looking to the long custody, the applicant deserves to be released on bail at this stage. 5. Per contra, learned State Counsel opposes the bail application and submits that the present applicant is the main accused. 6. The minor Victim is present in person and expressed no-objection to grant bail to the applicant. 7. Having considered the submissions made by learned counsel for the parties; the court statements of all the 3 victims and looking to the changing circumstances after rejection of the first bail application as also long custody of the applicant and since there is no immediate likelihood of concluding the case, without observing anything on merits of the case, I am inclined to release the applicant on regular bail. 3 8. Accordingly, this second bail application is allowed and the applicant is directed to be released on bail on his furnishing a bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed in that behalf.
