102 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CRM-M No.37918 of 2026 Date of Decision:-27.07.2026 Rajwinder Singh …..Petitioner. Versus State of Punjab .....Respondent. CORAM: HON’BLE MR. JUSTICE VIKRAM AGGARWAL ***** Present:- Mr. Manish Gilhotra, Advocate and Ms. Manpreet Kaur, Advocate for the petitioner. Ms. Ravinder Singh, DAG, Punjab. VIKRAM AGGARWAL, J. (ORAL) This is the third petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) for the grant of anticipatory bail in case FIR No.314 dated 06.12.2025 registered under Sections ANTF Wing, District SAS Nagar. 2. The first application was withdrawn on 22.01.2026 and the following order was passed:- “The present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail to the petitioner in case bearing FIR No.314 dated 06.12.2025 registered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police YAG DUTT 2026.07.28 17:06 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.37918 of 2026 -2- Station ANTF, SAS Nagar Mohali. Ludhiana, Punjab. 2. After arguing the matter at some length, learned counsel appearing on behalf of the petitioner seeks withdrawal of the present petition at this stage. 3. In view of the above, the present petition is dismissed as withdrawn. 4. Pending misc. Application(s), if any, shall stand disposed of.” 3. The second application for bail was withdrawn on 07.04.2026 and the following order was passed:- “The present second petition has been filed under Section 482 of the BNSS, 2023 for grant of pre-arrest bail to the petitioner in case bearing FIR No.314 dated 06.12.2025, under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station ANTF, SAS Nagar Mohali/Ludhiana. The first petition had been withdrawn, after arguing at some length, on 22.01.2026 in CRM-M-21-2026. On being confronted with maintainability of the petition, Counsel for the petitioner concedes that there has been no material change in the circumstances. In view of the above, no ground is made out for grant of pre-arrest bail as the present petition would not be maintainable in the facts of the present case. However, Counsel for the petitioner prays for withdrawal of the present petition. Dismissed as withdrawn.” 4. On receipt of a secret information that the petitioner (Rajwinder Singh), who was involved in the business of selling heroin since long and was having a Bullet motorcycle bearing registration No.PB- YAG DUTT 2026.07.28 17:06 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.37918 of 2026 -3- 39H-7213, could be apprehended if a check post was set up and a raid was conducted. On the receipt of the information, the petitioner is alleged to have been intercepted. However, he is alleged to have fled from the spot leaving his motorcycle behind from which, 508 grams of heroin was allegedly recovered. 5. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner is willing to join investigation and abide by any condition imposed by the Court. 6. Per contra, learned State counsel has opposed the prayer for the grant of anticipatory bail stating that there is no change in circumstances entitling the petitioner to maintain this third application for the grant of anticipatory bail. 7. I have considered the submissions made by learned counsel for the parties. 8. Coming first to the maintainability of the anticipatory bail application, the first application was withdrawn on 22.01.2026 after the matter was argued at some length. Thereafter, another anticipatory bail application was instituted which too was withdrawn on 07.04.2026. No change in circumstances has been shown but learned counsel submits that the petition be decided on merits. 9. The allegations against the petitioner are that he was intercepted on the basis of a secret information and 508 grams of heroin, which is a commercial quantity, was recovered from the motorcycle which he was riding, though the petitioner fled from the spot. The allegations are extremely serious and the custodial interrogation of the petitioner would be YAG DUTT 2026.07.28 17:06 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.37918 of 2026 -4- imperative to elicit the truth. 10. That being so, the petition is found to be devoid of merit and is accordingly dismissed.
