1. Memo of evidence filed in Court be taken on record. 2. It is submitted by the learned Advocate appearing for the petitioner that the petitioner has been implicated in this case on the basis of a statement made by the co-accused while in custody. Nothing has been recovered from the possession of the present petitioner. Moreover, the investigation of the case has already ended in a charge sheet against the present petitioner as well as other accused persons. He prays for anticipatory bail. 3. Learned Advocate appearing for the State opposes the prayer for anticipatory bail. 4. From the materials contained in the memo of evidence as

well as from the materials placed with the record, it transpires that the narcotic contraband was seized from the possession of one Rubbel Miah @ Rubel Miya @ Ruyep Islam. The said Rubbel Miah @ Rubel Miya @ Ruyep Islam Mia was taken into custody along with the seized narcotic drugs. Subsequently, the aforesaid Rubbel Miah @ Rubel Miya @ Ruyep Islam was granted bail by this Court by an order passed on June 22, 2026 in CRM (NDPS) 790 of
2026. Nothing appears to have been recovered from the possession of the present petitioner. His name has transpired from the statement of the co-accused recorded while in custody. 5. In such circumstances, I am inclined to grant anticipatory bail to the petitioner. 6.
Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default, the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to

this Court. 7. The prayer for anticipatory bail of the petitioner is allowed. 8. C.R.M. (A) 2378 of 2026 is disposed of. (Md. Shabbar Rashidi, J.)
