Mr. Manas Kumar Das, Mr. Aritra Kumar Thokdar …for the petitioner Petitioner herein is aggrieved with the inordinate delay caused in disposal of the criminal case being G.R. Case No.3630 of 2021 presently pending before learned 4th Judicial Magistrate, Krishnanagar. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that on the basis of petitioner’s complain, Krishnaganj Police Station Case No.267 of 2020 under Sections 498A/34 of the IPC was registered on 09.12.2020. After completion of investigation, police submitted charge-sheet on 31st January, 2021 and charge has been framed against the petitioner on 22.07.2025 thereby fixing next date for recording of evidence of the witnesses of the prosecution. The prosecution proposes to examine 8 witnesses but till date not a single witness could be examined and, as such, he prayed for necessary direction upon the Court below. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite 2 party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having heard learned Counsel for the petitioner and that the proceeding has practically got stalled for more than one year, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, let the CRR 3133 of 2026 be disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the said proceeding and to make his best effort to conclude the entire proceeding within a period of six months from the next date of hearing.
