Affidavit-of-service filed today be kept on record. 2. The case of the writ petitioner is that he made complaints regarding unauthorised construction at Premises No. 12B, Beni Banerjee Avenue, Kolkata- 700031, Ward No. 92. A proceeding under Section 400(1) of the Kolkata Municipal Corporation Act was drawn by the municipal authorities and by order dated 24th December, 2013, the Special Officer (Building) of the Kolkata Municipal Corporation declined to pass demolition order in respect of the said proceeding being Demolition Case No. 24-D/B- X/2012-13, Br.-X. 3. Being aggrieved, the writ petitioner preferred an appeal being B.T. Appeal No. 16 of 2014 before the Municipal Building Tribunal. By judgment and order dated 14th July, 2025, the Municipal Building Tribunal allowed the appeal being B.T. Appeal No. 16 of 2014 and remanded the matter before the Municipal Commissioner of the Kolkata Municipal Corporation for fresh adjudication in accordance with law, amongst other orders. 2 4. By letter dated 10th September, 2025 appearing at page-36 of the writ petition, the writ petitioner communicated the order passed by the Municipal Building Tribunal as mentioned above. However, till date the proceeding before the Municipal Commissioner in terms of the order passed by the Municipal Building Tribunal has not yet commenced. 5. Hence, the writ petition. 6. Heard the learned counsel appearing for the writ petitioner. Despite service, none appears for the respondents. 7. In the circumstances, the Municipal Commissioner of the Kolkata Municipal Corporation is directed to start the proceeding in terms of the order dated 14th July, 2025 passed by the Municipal Building Tribunal passed in B.T. Appeal No. 16 of 2014 positively within a period of eight weeks from the date of communication of this order. 8. WPA 29082 of 2025 stands disposed of. 9. There will be no order as to costs.
