Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. A. Ghosh …for the petitioner. Mr. Krishnendu Bhattacharyya Mr. Suraj Mikshra …for the State. Learned advocate for the petitioner submits that the petitioner has been implicated on the basis of the statement of co-accused and there are no materials to substantiate the accusation in the case, although there was recovery of 288 grm of Heroine from a co-accused. Learned advocate for the State opposes the prayer for anticipatory bail and submits that specific instructions was sought for regarding the money trail and CDR details. The report does not reflect money trail or CDR details but only statement of co-accused. Having regard to the same, I am of the view that custodial detention of the petitioner is unwarranted. Thus, prayer for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released subject to the satisfaction of the Arresting Officer and also 2 abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. As the charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks. Accordingly, the application for anticipatory bail being CRM(A) 846 of 2026 is allowed.
