Learned advocate for the petitioner submit that the petitioner is in custody since 17th May, 2023 and out of the 14 witnesses cited in the charge-sheet, 10 witnesses have already been examined. Learned advocate emphasizes on the grounds of delay without the merits being harped. Learned advocate for the State opposes the prayer for bail. I have taken into account the period of time which has passed and the fact that the case is at an advanced stage. Having regard to the overall circumstances, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.
2 However, the learned trial court would complete the rest of the prosecution’s witnesses within a period of six months from the next date fixed. Accordingly, CRM (M) 1476 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record. State is directed to communicate this order to the learned trial court. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
