This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No.263/2026 registered at Police Station – Civil Lines, District Bilaspur (C.G.) for the offence punishable under Sections 296, 115(2), 351(3), 109, 3(5) of Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that on the basis of a written report lodged by complainant Anand Chand Shrivas, the FIR bearing Crime No.263/2026 registered at Police Station Civil Lines, District Bilaspur for offences punishable under Sections 296, 115(2), 351(3), 109 and SATISH TUMANE Digitally signed by SATISH TUMANE Date: 2026.09.01 19:08:53 +0530
2 3(5) of the Bharatiya Nyaya Sanhita, 2023. It is alleged that on 20.02.2026 at about 7:30 PM near Lakhiram Auditorium, Bilaspur, the present applicant along with co-accused persons abused and assaulted Aditya Pratap Shrivas and his companions, causing injuries to them by means of a sharp-edged weapon and fists and kicks. During investigation, statements of witnesses were recorded, medical documents of the injured persons were collected. In connection with the said crime, the applicant apprehend his arrest.

Learned counsel for the applicant submits that the applicant vehemently argued that as per the allegations made in the FIR, the applicant along with other co-accused namely Vedant Gupta & Arnav @ Yug Mishra are said to have assaulted the injured with kicks and fists and a pointed weapon. He would submit that though the injuries which have been sustained by the two injured Om Prakash Yadav and Aditya Pratap Shriwas are on the vital part of the body i.e. neck and chest and further the injuries have been mentioned to be grievous in nature but it is not dangerous to life. It is submitted that the applicant was not named in the FIR. It is also submitted that the anticipatory bail application of the co-accused Vedant Gupta and one minor have been rejected by this Court vide order dated 10/04/2026 in MCRCA Nos.429 and 534 of 2026 and thereafter, an interim protection was granted to both the accused persons by the Supreme Court vide order dated 27/05/2026 and 16/07/2026 in Special Leave to Appeal (Criminal) Nos.10256/2026 and 12376/2026. It is submitted that the main allegation of assault against the accused-Arnav alias Yug Mishra, which anticipatory bail has been rejected by this Court vide order dated 10/04/2026 passed in MCRCA No.491 of 2026, and against which, an
3 SLP has been preferred by the accused (Special Leave to Appeal (Criminal) No.7860/2026, which has also been rejected by the Supreme Court vide order dated 04/05/2026. It is further submitted that regular bail has been granted to Arnav alias Yug Mishra by this Court vide order dated 23/06/2026 in MCRC No.5509 of 2026. He would further submit that the applicant undertakes to abide by any conditions imposed by this Court and, being permanent residents, there is no likelihood of absconding or tampering with evidence; hence, he deserves to be enlarged on bail.
4. On the other hand, learned State counsel, appearing for the non applicant/State, opposes the prayer for grant of anticipatory bail to the applicant.
5. I have heard learned counsel for the parties and perused all of the documents taken on record.
6. Considering the facts & circumstances of the case, submission of
learned counsel for the applicant, materials available on record, also considering the fact that the co-accused Vedant Gupta, who has been named in the FIR, has been granted anticipatory bail by the Supreme Court as mentioned above and the present applicant was not named in the FIR and he came into light in the subsequent development of recording statement of the injured and considering the fact that the co- accused Arnav @ Yug Mishra has been granted regular bail by this Court, without commenting on the merits of the case, this Court is of the considered opinion that the applicant has made out a case for grant of anticipatory bail.
7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Vaibhav Sharma, on executing a
4 personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of his adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
