Learned advocate appearing for the petitioner submits petitioner is in custody for 4 years and 7 months and till date only one witness has been examined. Although, prosecution has relied upon 14 witnesses.
Learned advocate for the State opposes the prayer for bail and submits that initially petitioner absconded for a period of 6 years.
Having considered that presently petitioner is in custody for 4 years and 7 months and there is no possibility of the trial being taken to its logical conclusion, I am of the opinion that petitioner should be released on bail.
2 Accordingly, Petitioner, namely, Jodu Sk @ Nur Salam Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1097 of 2026 is allowed.
