CRM-M-40115-2026 -1- IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 228 CRM-M-40115-2026 Date of decision : 28.07.2026 JARMANJEET SINGH @ JARMANPREET SINGH @ JAMMU ... PETITIONER Versus STATE OF PUNJAB ... RESPONDENT CORAM : HON'BLE MR. JUSTICE H.S.GREWAL Present:- Mr. Harmanpreet Singh, Advocate for the petitioner (through VC). Mr. Subhash Godara, Addl. A.G., Punjab. *** H.S. Grewal, J.(Oral) 1. The present petition has been filed under Section 483 of BNSS, 2023 (erstwhile Section 439 Cr.P.C.) seeking regular bail to the petitioner in case FIR No.6 dated 20.01.2025 registered under Section 109 of BNS, 2023, (corresponding Section 307 IPC) and Sections 25 and 27 of the Arms Act, 1959 at Police Station Mehta, District Amritsar Rural. 2. The case of the prosecution is that three unknown persons with muffled faces arrived on a motorcycle and called the complainant's son- Rajanpreet Singh, outside his house. When he came out into the street, one of the assailants fired a gunshot at him with the intention to kill, which hit him in the abdomen. Thereafter, all the assailants fled from the spot on the motorcycle. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and was not named in the FIR. It is SONIA GUGNANI 2026.07.28 17.20 I attest to the accuracy and integrity of this document Chandigarh CRM-M-40115-2026 -2- submitted that the petitioner was nominated solely on the basis of the disclosure statement of a co-accused, which is inadmissible in evidence. It is further submitted that the complainant-Hira Singh, and the injured witness- Rajanpreet Singh, have already been examined before the trial Court and have not supported the prosecution case and have been declared hostile. It is further submitted that no recovery has been effected from the petitioner. He also submits that the petitioner, who is 20 years of age, is in custody for the last more than 01 year, 02 months and 26 days. He, therefore, prays for release of the petitioner on regular bail. 4. Notice of motion. 5. On the asking of the Court, Mr. Subhash Godara, Addl. A.G., Punjab, accepts notice on behalf of respondent/State and vehemently opposes the prayer for grant of regular bail to the petitioner. He has filed the custody certificate of the petitioner in Court, which is taken on record. As per the custody certificate, the petitioner is in custody for the last more than 01 year, 02 months and 26 days. 6. I have heard the learned counsel for the parties and perused the record. 7. In view of the above submissions of learned counsel for the parties and keeping in view the facts that the petitioner, who is 20 years of age, is in custody for the last more than 01 year, 02 months and 26 days, he was not named in the FIR, no recovery has been effected from him, the material prosecution witnesses have not supported the prosecution case qua the involvement of the petitioner and that the trial is likely to take a long time to conclude, therefore, this Court deems it appropriate to grant the concession of SONIA GUGNANI 2026.07.28 17.20 I attest to the accuracy and integrity of this document Chandigarh CRM-M-40115-2026 -3- regular bail to the petitioner during the pendency of the trial as the continuous detention of the petitioner would not serve the ends of justice. 8. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 9. However, it is made clear that in case the petitioner misuses the concession of bail, the State/complainant would be at liberty to seek cancellation of his bail.
