THIS MFA FILED U/S.173(1) OF MV ACT, AGAINST THE JUDGMENT AND AWARD DT.21.02.2022 PASSED IN MVC NO.4621/2020 ON THE FILE OF THE I ADDITIONAL SMALL CAUSES JUDGE, MACT, BENGALURU, (SCCH-11), ALLOWING THE CLAIM PETITION FOR COMPENSATION AND SEEKING ENHANCEMENT OF COMPENSATION. THIS APPEAL IS COMING ON FOR CONCILIATION BEFORE NATIONAL LOK-ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
1. Learned Counsel appearing for the appellants/claimants is present. Learned Counsel appearing for Respondent No.2/
3 Insurance Company along with its representative are also present. 2. After detailed negotiations, the matter has been settled between the parties. A Joint Memo signed by the learned Advocate appearing for the appellants/claimants (being authorized by the appellants/claimants to sign) and the learned Advocate appearing for respondent No.2/Insurance Company and an authorized officer has been filed. The appellants/claimants have agreed to receive and respondent No.2/Insurance Company has agreed to pay a lump-sum of Rs.50,000/- (Rupees Fifty Thousand), in addition to what has been awarded by the learned Tribunal, in full and final settlement of the claim. 3. The learned Tribunal has awarded interest at 6% on the compensation amount. The learned counsel for the parties have agreed to an enhancement of interest. 4.
Accordingly, we award interest at 8% per annum on the additional amount of Rs.50,000/- (Rupees Fifty Thousand) from the date of filing of the petition till the date of realization. 4

The respondent No.2/Insurance Company has agreed to deposit the said amount before the learned Tribunal within six weeks from the date of preparation of award, failing which the said amount shall carry interest at the rate of 9% per annum from the date of default, till the date of deposit. 6. The entire enhanced compensation amount shall be released in favour of the appellants/claimants, on proper identification. 7. This Miscellaneous First Appeal stands disposed of in terms of the Joint Memo. The Judgment and Award of the learned Tribunal shall stand modified accordingly and shall be communicated to the learned Tribunal for appropriate action at the earliest. Sd/- JUDGE
