In connection with Berhampore P.S Case no.2126 of 2024 dated 28/12/2024 under Sections 21(c)/29 of the NDPS Act. In the matter of: Mustak Ahamed MOndal @ Nantu & Ors. …Petitioners. Ms. Shabana Hasin …for the petitioners. Mr. Gourang Kr. Das Mr. Sunil Gupta …for the State. Learned advocate appearing for the petitioners submits that the petitioners are in custody for one year two months and till date that trial has not progressed. Learned advocate appearing for the State opposes the prayer for bail and submits that from all the four petitioners 10040 bottles of phensedyl were recovered out of which 10000 bottles have been seized from the petitioners. Having considered the huge recovery in the present case, I am of the opinion rigours of Section 37 of the NDPS Act is attracted. As such, the petitioners are not entitled to release on bail. At this stage, CRM (NDPS) 1001 of 2026 is dismissed. The petitioners will renew their prayer for bail after the evidence of seizure list witnesses are over. 2 The Investigating Officer of the case is present in Court and has instructed the learned Additional Public Prosecutor that there is videography available in respect of seizure which was effected. Further appearance of the Investigating Officer is dispensed with. Mr. Das along with his junior Mr. Gupta, who appear on behalf of the State, their names be regularized by the competent authority in due course of time.
