Affidavit of service filed by the petitioners is taken on record. The petitioners and other members of Daldali Gram Panchayat submitted a no confidence motion for removal of the Pradhan of the Panchayat before the Prescribed Authority on 9th September, 2025 which has lapsed due to efflux of time. A further no confidence motion was submitted by the petitioners on 23rd March, 2026 on the same ground. The petitioners seek a direction upon the Prescribed Authority to consider the same. It appears that the motion submitted on 23rd March, 2026 has also lost its force due to efflux of time. The motion contains several allegations against the Pradhan and is therefore stigmatic. It is trite law that a motion containing stigma cannot sustain in the eye of law. However, the petitioners and other members of the Panchayat are granted liberty to submit a fresh motion before the Prescribed Authority in terms of Section 12 of 2 The West Bengal Panchayat Act, 1973. In the event such motion is submitted, the Prescribed Authority and the Block Development Officer, Hura, being the 5th respondent herein, shall take necessary steps in terms of the said provision of law, particularly the time frame stipulated therein. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
