This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 383/2025 registered at Police Station – Abhanpur, District – Raipur (C.G.), for the offence punishable under Sections 296, 109 of the Bhartiya Nyaya Sanhita, 2023 and Secdtion 25(1 ख)(ख) and 27(1) of the Arms Act. 2. According to the prosecution story, the complainant, Chandrashekhar Sahu, lodged a written report at the Police Station on 20.10.2025, alleging therein that on the same day, i.e., 20.10.2025, after purchasing ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.09.01 16:09:56 +0530 2 the required festival articles, he was waiting for a bus at Abhanpur Bus Stand. At that time, the applicant approached him and, after using filthy language, assaulted him with a knife on different parts of his body, namely, the left side of his body, left thigh, and left elbow. When the complainant raised an alarm, the applicant fled from the spot. Thereafter, the police registered the First Information Report vide Crime No. 0383/2025 for the offences punishable under Sections 296 and 109 of the BNS, 2023. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He submits that there is no direct allegation against the applicant and that the allegations levelled against him are vague in nature. He further submits that, looking to the material available on record, no prima facie case is made out against the applicant. He submits that the final report/charge-sheet has been filed in the present case and the statements of the prosecution witnesses are being recorded. He further submits that the applicant has been in custody since 20.10.2025 and that the conclusion of the trial may take some time. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that the allegations against the applicant are serious in nature. She submits that, on 20.10.2025, the applicant allegedly approached the complainant at Abhanpur Bus Stand, abused him in filthy language, and assaulted him with a knife on different parts of his body, including the left side of his body, left thigh, and left elbow. She further submits that the applicant fled from the spot after the complainant raised an alarm. She submits that the allegations are duly supported by the material available on record and, therefore, the applicant does not deserve the benefit of bail. 3 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the nature and gravity of the allegations levelled against the applicant, the specific allegation that he assaulted the complainant with a knife on different parts of his body, including the left side of the body, left thigh, and left elbow, and the fact that the incident occurred at a public place and the material available on record prima facie discloses the involvement of the applicant in the alleged offence. Therefore, this Court is not inclined to grant regular bail to the applicant. 7. Accordingly, the first bail application of the applicant – Akash Markam, involved in Crime No. 383/2025 registered at Police Station – Abhanpur, District – Raipur (C.G.), for the offence punishable under Sections 296, 109 of the Bhartiya Nyaya Sanhita, 2023 and Secdtion 25(1 ख)(ख) and 27(1) of the Arms Act, is rejected. 8.
