Sushil Kukreja, Judge (Oral) The instant appeal has been preferred under Section 54 of the Land Acquisition Act, 1894 (for short, ‘the Act’) by the appellants- State against the award dated 26.09.2016, passed by the learned District Judge, Kinnaur at Rampur Bushahr, District Shimla, HP, with the prayer to set aside the impugned award. 2. Learned counsel for the appearing parties are ad idem to the fact that the instant appeal is squarely covered by a common 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 ( 2026:HHC:12539 ) judgment dated 05.09.2018 passed by a Co-ordinate Bench of this Court in a batch of appeals, lead case being RFA No.12 of 2018, titled as State of HP & others vs. Gopal Chand & others. 3. Since the point in issue is covered by the judgment passed in Gopal Chand’s case (supra), there is no need to discuss the facts and circumstances as well as the evidence in detail and the instant appeal as well as the cross-objections can be disposed of in terms of the said judgment. A perusal of the judgment passed in Gopal Chand’s case (supra), reveals that the market value of the acquired land assessed/fixed by the learned Reference Court @ Rs.33,333/- per biswa (Rs.6,66,660/- per bigha), has been held to be just and reasonable. 4. Therefore, in view of the above, no interference is required in the impugned award dated 26.09.2016, passed by the learned District Judge, Kinnaur at Rampur Bushahr, District Shimla, HP. Consequently, the instant appeal as well as the cross objections, being devoid of merits, deserve dismissal and are accordingly dismissed.
