JUSTICE ANU SIVARAMAN) We have heard Sri A.K.Vasanth, learned counsel appearing for the appellant and Sri M.D.Raghunath, learned counsel appearing for the respondent. 2. A joint memo has been filed by the appellant and respondent, which reads as follows: The Appellant and the Respondent named above respectfully submit as follows: The Appellant and the Respondent herein have settled the matter amicably. As per the settlement arrived between the parties, the Appellant is paying Rs.2,00,000/- (Rupees Two Lakhs Only) through - 3 - HC-KAR CNR: KAHC010114392022 NC: 2026:KHC:39250-DB COMAP No. 132 of 2022 Demand Draft/pay order bearing No.000450, dated 29.06.2026, drawn on The Hotel Industrialists' Co-op Bank Ltd., Bangalore to the respondent as full and final settlement. By virtue of the earlier order of this Hon'ble Court the appellant had deposited Rs.5,95,000/- (Rupees Five Lakhs Ninety Five Thousand Only) and the said amount of Rs.5,95,000/- (Rupees Five Lakhs Ninety Five Thousand Only) got released by the respondent with consent of the appellant. The respondent has agreed and received the amount/s as full and final settlement amount of the above dispute, no more claims from the respondent herein. Both the parties here by agrees that this is the full and final settlement. Hence, this Joint Memo filed by both the Appellant and Respondent herein. WHEREFORE, both the parties respectfully prays that, this Hon'ble Court may please to pass appropriate orders in these terms in the ends of justice and equity." 3. The learned counsel for the respondent submits that an amount of Rs.2,00,000/- has been received by way of Demand Draft as a full and final settlement and the amount in deposit has also been released to the respondent. 4. In view of the settlement arrived at between the parties, joint memo is accepted. This commercial appeal is disposed of in terms of the joint memo. 5.
