11/09.04.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the Respondents. 2. The petitioner in this writ petition has prayed for commanding upon the Respondents authorities specially Respondents No. 1 to 4 for settlement of the sub-lease of land for residential purpose in the name of ex-MLA from the Jamshedpur West legislative constituency in the light of the application to the Deputy Commissioner cum President appropriate machinery committee also the Secretary, Department of Revenue and Land Reform Government of Jharkhand, Ranchi for the plot having following description-situated in the Mouza Beldih P.S. No. 1154, Khata No. 2, R.S. Plot No. 1853 Part

having total area 0.12 acre according to the 1934-37 R.S. record of Survey. 3. Just because the petitioner is an ex-MLA of the State, recommendation has been made by the Deputy Commissioner to allot a land for residential purpose in prime area of Jamshedpur. The act of the Deputy Commissioner is absolutely against the law. Admittedly, the land was leased out to Tata Steel and same is pending for renewal in favour of the Tata Steel. Even the Tata Steel, also without a proper policy, cannot deal or settle land to any private individual or any person. These lands are primarily of the State, leased out to the Tata Steel. 4.
Prima facie, I am of the opinion that if these lands are settled in such manner, in which the Deputy Commissioner has proposed, it will create anarchy. These types of lands, if at all needs to be settled, should be by way of auction or by way of lottery and not by the said manner, which has been done here, i.e. pick and choose method, which has got no space in our Constitution. 5. Further, in this writ petition, the petitioner has claimed for settlement of the land on the ground that another ex-MLA has been settled some land. This cannot be a ground to settle the land in favour of the petitioner. 6. If a wrong has been committed, the same cannot be allowed to be perpetuated. Illegality always remains an illegality. The petitioner cannot claim any benefit out of the same. Further, a particular ex- MLA or any person has got no right to get the said settlement of

land. 7. These types of properties / lands, if at all needs to be settled, can be settled as per the proper policy, where every person should get an opportunity to be considered for settlement. There cannot be pick and choose method, which has been prayed in this case. 8. Thus, I find no ground to give any benefit to this petitioner. 9. Accordingly, this writ petition is dismissed.
