284 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CRM-M No.38491 of 2026 Date of decision: 28.07.2026 Hardeep Singh and others …Petitioners Versus State of Punjab and another …Respondents CORAM: HON’BLE MS. JUSTICE MANDEEP PANNU Present :- Mr. Jatinder Singh Gill, Advocate for the petitioners. Mr. Navraj S. Mahal, DAG, Punjab for respondent No.1-State. None for respondent No.2. ***** MANDEEP PANNU, J. (Oral) 1. The present petition has been filed under Section 482 of BNSS, 2023 (corresponding Section 438 Cr.P.C.) for grant of the concession of anticipatory bail to the petitioners in FIR No.79 dated 15.05.2025, registered under Sections 498-A and 406 IPC (now Sections 85 and 316 of the Bharatiya Nyaya Sanhita, 2023), at Police Station City Batala, Police District Batala, District Gurdaspur. 2. The facts of the case, in brief, are that the marriage of the complainant was solemnized with petitioner No.2 Nirmaljit Singh on 30.06.2021. There are allegations of entrustment and misappropriation of the dowry articles, as well as harassment and cruelty at the hands of the petitioners. There are also allegations that the complainant suffered a NEETU RANI 2026.07.28 16:52 I attest to the accuracy and authenticity of this order/judgment PHHC, CHD CRM-M No.38491 of 2026 -2- miscarriage for which the petitioners have been held responsible. 3. Learned counsel for the petitioners has submitted that the matter has been amicably compromised between the parties. It is submitted that the compromise deed, Annexure P-3, is on the record and the same has been duly signed by the parties, including the complainant, Prabjot Kaur. It is further submitted that in terms of the compromise, the agreed amount has already been paid by the husband/petitioner to the complainant. 4. On the other hand, learned State counsel has submitted that he is not aware of any such compromise between the parties. However, he has opposed the petition by contending that there are serious allegations against the petitioners. 5. None has put in appearance on behalf of respondent No.2 today. However, respondent No.2 was present before this Court on 27.07.2026. 6. I have heard learned counsel for the parties and have gone through the record carefully. 7. It is not in dispute that the parties have entered into a compromise, which has been placed on record as Annexure P-3. It is also relevant to mention that all the three petitioners had earlier been declared proclaimed offenders. However, the order declaring them proclaimed offenders has already been set aside by this Court vide order dated 16.07.2026 passed in CRM-M-38479-2026. It has further been brought to the notice of this Court that in pursuance of the settlement, the agreed amount has already been paid by the husband to the complainant. It has also been pointed out that the mother-in-law is already on bail. Thus, the NEETU RANI 2026.07.28 16:52 I attest to the accuracy and authenticity of this order/judgment PHHC, CHD CRM-M No.38491 of 2026 -3- dispute between the parties, which arises out of a matrimonial discord, now stands amicably settled. 8. Without expressing any opinion on the merits of the case and keeping in view the compromise arrived at between the parties, the payment made in terms thereof, the fact that the order declaring the petitioners as proclaimed offenders has already been set aside, and the overall facts and circumstances of the case, this Court is of the considered view that the petitioners deserve the concession of anticipatory bail. 9. Accordingly, the present petition is allowed, and in the event of arrest, the petitioners shall be released on anticipatory bail, subject to their furnishing adequate bail bonds and surety bonds to the satisfaction of the Arresting/Investigating Officer concerned and subject to the conditions envisaged under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 10. However, nothing observed herein shall be construed as an expression on the merits of the case. 11. All pending applications, if any, also stand disposed of.
