Learned advocate appearing for the petitioner submits that the petitioner was arrested on or about 22.06.2025 and is in custody for 1 year 2 months. According to the petitioner, the complaint which has been submitted relies upon 10 witnesses in order to prove its case. There is no possibility of the trial being taken to its logical conclusion as till date charges have not been framed before the learned trial court.
Learned advocate appearing for the Air Custom Authorities submits that the quantum of seizure is of commercial quantity as 23.943 kgs. of ganja were recovered from the present
2 petitioner. Petitioner was returning from Bangkok and consciously had been carrying such contraband above commercial quantity.
I have taken into account the materials appearing in the case diary including the seizure list. Prima facie, I am of the view that Section 37 of the NDPS Act is attracted in the present case. However, having regard to the period of detention already undergone, I direct the learned trial court that if within a period of six months after framing of charges the seizure list witnesses are not examined, learned trial court would release the petitioner on bail after the aforesaid time schedule is over.
Accordingly, CRM(NDPS) 1574 of 2026 is dismissed at this stage.
Learned trial court would adhere to the directions passed above.
