The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.504/2023, registered at Police Station Akaltara, District : Janjgir- Champa (C.G.) for alleged commission of offence punishable under Sections 394, 395, 34 of IPC. 2. The prosecution case, in brief, is that the complainant, Dharmendra Maneshwar-who drives a truck (Registration No. CG-04 NA-5687) for J.K. Transport, Balaghat had parked his vehicle at Aalha Petrol Pump, SATISH TUMANE Digitally signed by SATISH TUMANE Date: 2026.09.02 11:33:30 +0530 2 Akaltara, and was resting on October 7, 2023. Between 3:00 and 4:00 AM, three or four individuals arrived in a white Scorpio; they assaulted the complainant, telling him to flee or else they would burn him alive. The accused were armed with dangerous rods; one of them approached the driver's cabin, dragged the complainant out, and robbed him of ₹1,860 kept in his shirt's front pocket. Furthermore, while threatening to kill him, the group stole 150-200 liters of diesel from the truck. Following the report lodged by the complainant at the police station, a case was registered against the accused under Section 392 of the IPC. Hence this anticipatory bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that though the applicant has been named in the FIR, but general allegations have been leveled against him. It is further submitted that the FIR contains only omnibus allegations against the applicant. It is submitted that the applicant was not present at the scene of occurrence and without any basis, he has been involved in this case. It is lastly submitted that the applicant is ready and willing to abide by all the conditions which may be imposed by this Court. Thus, he may be enlarged on anticipatory bail. 4. On the other hand, learned counsel appearing for the respondent/State, opposes the prayer for grant of anticipatory bail to the applicant and submits that the applicant has been named in the FIR and in this case, he has been involved in committing theft of diesel from the truck and there are three criminal antecedents against the present applicant, in which one case involves theft, therefore, he may not be enlarged on anticipatory bail. 3 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the applicant, the nature of allegations, the material available on record and the fact that the FIR contains specific allegations against the present applicant and there are three criminal antecedents against the present applicant, in which one case involves theft, this Court is of the considered opinion that the applicant has not made out a case for grant of anticipatory bail. 7. Accordingly, the anticipatory bail application of the applicant -Sangram Singh Ratre involved in Crime No.504/2023, registered at Police Station Akaltara, District : Janjgir-Champa (C.G.) for alleged commission of offence punishable under Sections 394, 395, 34 of IPC, is rejected.
