07/08/2026 D/L – 45 Court No.35 S. Kundu
C.R.M.(A) 774 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Hare Street P.S case no. 332 of 2024 dated 30/11/2024 under Sections 420/467/468/471/406/120B of the IPC. In the matter of: Surendra Singh Saluja ...Petitioner. Mr. Manish Ojha …for the petitioner. Mr. Surajit Saha …for the de-facto complainant. Mr. Pritam Roy …for the State.
Records of the case reflect that petitioner after filing the application on two occasions did not appear. The matter was earlier called on 08/06/2026 when the petitioner did not appear. The case was registered in the year 2024 with Hare Street Police Station. Learned advocate for the State submits that during the pendency of the application charge sheet has already been submitted before the jurisdictional court. In view of the petitioner not participating for a period of more than two months, I am of the opinion that further pendency of the instant application is unwarranted. As the charge sheet has been submitted, prima facie offence is made out the petitioner be better advised to approach the regular court for bail.

The regular court considering the application for bail would independently consider the merits of the case without being influenced by any observations made by this Court. Accordingly, the application for anticipatory bail being CRM(A) 774 of 2026 is disposed of. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
