Kalyani Bandyopadhyay @ Sakar -vs- Samir Kumar Bandyopadhyay Mr. Shounak Mondal … for the petitioner In this application petitioner has made an innocuous prayer that the court below may be directed to take its best endeavour for expeditious disposal of the Criminal Appeal being No. 32 of 2015 presently pending before learned Additional Sessions Judge, 18th Court, Alipore, South 24 Parganas. Being aggrieved by the inordinate delay caused in disposal of the appeal, learned counsel for the petitioner submits that the Trial Court convicted the opposite party by a judgment of conviction and order of sentence dated December, 26, 2014. Being aggrieved by that judgment the opposite party/convict preferred the aforesaid Criminal Appeal No. 32 of 2015. Said appeal is pending for disposal for last eleven and a half years. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the private opposite party will have no cause to prejudice and as such, service of copy of application upon the private opposite party is hereby dispensed with. Having considered the facts and circumstances of the case and that the appeal is pending for disposal for last eleven and a 2 half years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, CRR 723 of 2026 is hereby disposed of with a direction upon the court below to dispose of the Criminal Appeal being No. 32 of 2015 within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties.
