The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 249/2025, registered at Police Station – Surajpur, District – Surajpur (C.G.) for alleged commission of offence punishable under Section 317(4), 318(2) and 61(2)(A) of the BNS and Section 66(D) of the IT Act. 2. As per the prosecution story in brief, is that on the occurrence of the cyber fraud, various victims have lodged their complaints through online medium layer-1 operated in various bank branches. In co- ordination with the Samanvaya portal operated by Indian Cyber Crime Coordination Centre (in short 14C). Thereafter, in relation to take action on this regard, the copy of complaints received by the Office of RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 Inspector General of Police Raipur Chhattisgarh. On such complaint the investigation was carried out and during investigation it was revealed that, one of the accused namely Anand Kumar Kurre and Narendra Kurre have used Bank of Maharastra and two other co- accused namely Pushpendra Patel and Priyanshu Patel (now both dead) account of Axis bank was used as mule accounts. Moreover, as per the investigation and final report filed by the investigating agency on 18 complaints letter the total about 10 bank accounts were used and sum of total Rs. 3,99,800/- (three lakh ninety nine thousand eight hundred Rupees) transaction was made in cyber fraud. Hence, this application. 3. The learned counsel for the applicant has argued that two of the co- accused persons have been granted regular bail by this Court vide orders dated 07.01.2026 and 20.04.2026 passed in MCRC Nos. 9117/2025 and 2096/2026. Hence, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that the applicant along with the co- accused persons have involved in the criminal activities of cyber fraud, and so far as the regular bail granted to the co-accused persons are concerned, this is an anticipatory bail application, whereas the said co- accused were already arrested and thereafter were granted regular bail by this Court. It is submitted that Cyber fraud amounting to Rs.3,99,800/- was committed through a total of 10 bank accounts belonging to the accused themselves and those used by them, in connection with 18 complaints registered in the cyber cell. Therefore, 3 the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicant in the FIR, it transpires that the applicant along with the co-accused persons have involved in the criminal activities of cyber fraud, and so far as the ground of regular bail granted to the co- accused persons are concerned, this is an anticipatory bail application, whereas the said co-accused were already arrested and thereafter were granted regular bail by this Court, and Cyber fraud amounting to Rs.3,99,800/- was committed through a total of 10 bank accounts belonging to the accused themselves and those used by them, in connection with 18 complaints registered in the cyber cell, thus, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the Anticipatory Bail application of the applicant – Narendra Kurre, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 249/2025, registered at Police Station – Surajpur, District – Surajpur (C.G.) for alleged commission of offence punishable under Section 317(4), 318(2) and 61(2)(A) of the BNS and Section 66(D) of the IT Act, is rejected.
