1. Affidavit of service filed in Court today is taken on record. It indicates that service on the respondent no.4 is complete. The postal article sent to the respondent no.5 has returned with the endorsement “no such person in the address”. 2. This writ petition alleges inaction on the part of the respondent CESC Authorities in shifting of service connection from the portion of the premises where it initially was to the premises which is now under occupation of the petitioner. It is the petitioner’s case that the respondent nos. 4 and 5 are the neighbours of the petitioner and they have been unjustly resisting such shifting. The electricity supply which the petitioner is presently enjoying is being catered through a service connection
2 which is located at Sarangabad, Panchanantala Road. The petitioner wants the same to be shifted at D2-38, New Panchanantala Road, Dudge Budge. 3. It is submitted that the respondent nos.4 and 5 have been unjustly objecting and resisting to such shifting from the earlier premises to the present premises. 4. Learned Advocate appearing for the respondent CESC Authorities submits that the CESC Authorities have already received payment from the petitioner and there is no impediment on the part of the CESC Authorities in effecting the shifting work. However, the CESC Authorities could not execute the job due to resistance put up by the private respondents. 5. Since, the matter is one where the service connection is being shifted from the premises which is in the occupation of the private respondents to the premises which is in the occupation of the petitioner, the private respondents cannot object to the shifting. 6. In such view of the matter, the respondent CESC Authorities are directed to execute the job of shifting within four weeks from the date of the petitioner complying with all formalities, if any. The CESC Authorities will be fee to approach the Officer-in-Charge, Mahestala
3 Police Station in case they face any resistance/objection at the instance of the respondent nos.4 and 5. 7.
If the Office-in-Charge, Mahestala Police Station is approached by the CESC Authorities seeking police assistance for the purpose of execution of the job of shifting as aforesaid, the Officer-in-Charge, Mahestala Police Station would provide adequate police assistance to the CESC Authorities. Costs of such police assistance would be borne by the petitioner. 8. WPA 16864 of 2026 stands disposed of. No costs. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
