CORAM: HON'BLE MR. JUSTICE HARPREET SINGH BRAR Present : Ms. Sanchit Punia, Advocate for the petitioners. Mr. Naveen Singh Panwar, DAG Haryana. **** HARPREET SINGH BRAR
, J. (Oral)
1. This Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction, particularly a writ in the nature of certiorari, for quashing the impugned relieving order dated 24.07.2026 (Annexure P-17), whereby the petitioners have been relieved from GGJ Government College, Hisar with immediate effect; and further for issuance of a writ in the nature of mandamus, directing the respondents to permit the petitioners to continue in PARUL VERMA 2026.07.28 16:31 I attest to the accuracy and authenticity of this
order/judgment.
2 CWP-23291-2026 service at GGJ Government College, Hisar in terms of the extension order dated 22.06.2026 (Annexure P-14), along with all consequential benefits.
2.
Learned counsel for the petitioners, inter alia, contends that the impugned relieving order dated 24.07.2026 is arbitrary, discriminatory and contrary to the Policy/Guidelines dated 04.03.2020 governing the deployment of regular Assistant Professors and engagement of Extension Lecturers. It is submitted that the petitioners are regular Assistant Professors appointed through the Haryana Public Service Commission and were transferred to GGJ Government College, Hisar from their respective parent colleges under Government orders. Their tenure at GGJ Government College, Hisar stood extended up to 30.09.2026 vide order dated
22.06.2026.
2.1.
Learned counsel further submits that, as per the Policy/Guidelines dated 04.03.2020, Extension Lecturers can be engaged only after allocation of workload to regular Assistant Professors and are liable to be discontinued once regular faculty is available. However, despite the availability of workload and the presence of the petitioners, the respondents have relieved the petitioners while permitting Extension Lecturers to continue in their respective subjects, which is ex facie contrary to the governing policy.
PARUL VERMA 2026.07.28 16:31 I attest to the accuracy and authenticity of this
order/judgment.
3 CWP-23291-2026
2.2. It is further contended that the respondents have completely ignored the workload statement dated 16.05.2026 while passing the impugned relieving order and have adopted a course of action that defeats the very object of the policy. Accordingly, learned counsel submits that the impugned relieving order deserves to be quashed and the petitioners be permitted to continue at GGJ Government College, Hisar in terms of the extension order dated 22.06.2026.
2.2. At this stage, learned counsel for the petitioners confines the prayer to the limited extent that the petitioners would be satisfied if their representation dated 24.07.2026 (Annexure P-18) is decided by respondent No.1/competent authority by passing a speaking order within a time-bound period.
3. Learned State counsel, appearing on advanced notice, submits that petitioners have no right to claim posting of their choice and that they were earlier working on deputation. Further, he has no objection in case a direction is issued to the respondent No.1/competent authority for time- bound consideration and decision of the representation dated 24.07.2026 (Annexure P-18) of the petitioners by passing a speaking order.
4. Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondent No.1/competent authority is directed PARUL VERMA 2026.07.28 16:31 I attest to the accuracy and authenticity of this
order/judgment.
4 CWP-23291-2026 to consider and decide the representation dated 24.07.2026 (Annexure P-18) of the petitioners and pass a speaking order, after affording them an opportunity to be heard, within a period of 02 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by the respondent.
5.
Disposed of, accordingly.
