Accused in Crime No.115/2026 registered by Hassan Extension Police Station, Hassan, for the offences punishable under Sections 318 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.115/2026 was registered by Hassan Extension Police Station, Hassan, for the aforesaid offences against unknown two persons, based on the first information dated 17.04.2026 received from Sathish S/o Balakrishna who is the alleged victim in the present case. During the course of investigation, petitioner was arrested on 05.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.654/2026 was rejected on 02.07.2026. Therefore, petitioner is before this Court. - 3 - HC-KAR CNR: KAHC010464792026 NC: 2026:KHC:42956 CRL.P No. 10027 of 2026 4. It is the case of the prosecution that accused persons had made false representations to the alleged victim that they will double his money and after collecting money from him, they had handed over to him a bag stating that his money was doubled, asked him to count the money in his car, and left the spot. Subsequently, when the said bag was opened in the car of the alleged victim, it was found that the said bag contained bricks and gunny bag, and there was no money. It is under these circumstances, FIR was registered against unknown persons. 5. During the course of investigation, petitioner was arrested and remanded to judicial custody. Investigation of the case is completed and charge sheet has already been filed. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the said offences is imprisonment for a period of seven years. Learned Counsel for the petitioner submits that petitioner has no other criminal antecedents. Under the circumstances, I am of the opinion that petitioner's prayer for grant of - 4 - HC-KAR CNR: KAHC010464792026 NC: 2026:KHC:42956 CRL.P No. 10027 of 2026 regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.115/2026 registered by Hassan Extension Police Station, Hassan, for the offences punishable under Sections 318 read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR CNR: KAHC010464792026 NC: 2026:KHC:42956 CRL.P No. 10027 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
