12.08.2026 Item No.04 Court No.30 g.b. Calcutta High Court Criminal Revisional Jurisdiction Appellate Side
CRR 1097 of 2023 With CRAN 2 of 2026
Shib Sankar Jana & Ors. Vs. State of West Bengal & Anr.
Ms. Pronoti Goswami …….For the Petitioners Mr. A. K. Das ……For the Opposite Party No.2
In Re: CRAN 2 of 2026
1. CRAN 2 of 2026 has been filed by the de facto complainant praying for appropriate orders in the present case on the ground that he does not wish to proceed with the complaint before the Trial Court
2. It appears that the offences alleged in the present case are under Sections 143/149/323/324/325/326/ 307/354(B)/506 of the Indian Penal Code.
3. Considering the nature of offences alleged and the application vide which an order has been prayed, which it appears is not a petition of joint compromise, as the same has not been signed by the petitioners, though it is the de facto complainant who prays for withdrawal of the case, no effective order can be passed on such prayer.

4. Accordingly, on hearing the learned counsels for the parties, the criminal revisional application along with CRAN 2 of 2026 is disposed of with liberty granted to the parties to approach the Trial Court and pray for necessary relief.
5. CRR 1097 of 2023 along with CRAN 2 of 2026 stands disposed of.
6. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties on urgent basis after completion of all necessary formalities.
