C.R.M.(A) 2022 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Hatishala P.S. Case No. 48 of 2026 dated 10/03/2026 under sections 85/103(1)/3(5) of the BNS. In the matter of: Nayan Ali Mallik @ Nayan Ali Mallick & Anr. …Petitioners. Mr. Robiul Islam Mr. Subham Bhakat Mr. Masooq Rahman Mr. Masum Tarafder …for the petitioners. Mr. Anirudha Sarkar …for the State.
Learned advocate appearing for the petitioners submits that the petitioners are parents of the husband of the deceased. The incident happened after two years of the marriage having been solemnized. Learned Additional Public Prosecutor opposes the prayer for anticipatory bail and submits that the death was due to manual strangulation and the opinion of the doctor subsequently revealed that it is not possible for a single individual to commit such offence. Charge sheet has already been submitted. However, having regard to the close proximity of time after which the deceased’s life was terminated at her matrimonial home and the petitioners happen to be inmates, were present at the relevant point of time, I am of the

opinion that this is not a fit case to grant anticipatory bail to the petitioners. Accordingly, CRM(A) 2022 of 2026 is dismissed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
