Mr. Bhaskar Prosad Banerjee Mr. Aniket Mitra Mrs. Anupurba Banerjee Ms. Shalini Ghosh …for the petitioner Mr. Amajit De …for the CBI The petitioner who is the hapless mother of the victim who expired under mysterious circumstance at the age of eighteen years on September 26, 2009 seeks transfer of Case No. RC3(S)/2019-CBI,SCB,Kolkata dated August 17, 2019 pending before the learned Chief Judicial Magistrate, Burdwan to the learned Chief Judicial Magistrate, Calcutta on the ground that she is facing severe non-cooperation from the department of the Court in receiving certified copies of documents and other matters. Also, she has lost her husband in the meantime and it is difficult for her to travel to Burdwan from her residence in Kolkata to attend the proceeding at Burdwan on every date. Learned counsel for the CBI submits, on instruction, that the matter be left to the discretion of the Court and the respondent has no comments to offer. In view of the fact that other two cases which may have some connection with the present matter have been transferred by this Court to the learned City Sessions Court, Calcutta, the
present case be also transferred to the Court of the learned Chief Judicial Magistrate, Calcutta for disposal. Case No. RC.3(S)/2019-CBI,SCB,Kolkata dated August 17, 2019 pending before the learned Chief Judicial Magistrate, Burdwan be transferred to the learned Chief Judicial Magistrate, Calcutta for disposal. The learned Chief Judicial Magistrate, Calcutta shall either deal with the case himself or assign the same to any other learned Judicial Magistrate within his jurisdiction for disposal. The learned Chief Judicial Magistrate, Burdwan is directed to transmit the case record alongwith relevant documents to the learned Chief Judicial Magistrate, Calcutta within 10 days from the date of communication of this order. The revisional application is accordingly allowed. There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh,J) 2
