This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 0107/2025 registered at Police Station – Basantpur, District – Balrampur - Ramanujganj (C.G.), for the offence punishable under Sections 15(c), 25 and 29 of the Narcotics Drugs and Psychotropic Substances Act. 2. The brief case of the prosecution is that on 07.06.2025, during night patrolling, Sub-Inspector Narendra Tiwari received secret information that a Tata Ultra truck bearing Registration No. RJ-19-GJ-7447 was parked near the RTO barrier at Dhanwar Check Post. 2 the driver had abandoned the vehicle. Upon checking the said vehicle, the police recovered 90 plastic sacks containing illegal Doda, weighing a total of 14 quintals and 44 kilograms, valued at approximately Rs. 1,30,00,000/-. Subsequently, a case under the provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985, was registered against the applicant. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article 14 quintals and 44 kilograms of Doda was not seized from the possession of the present applicant. She also submits that the trial in the present case has already commenced, and the two independent seizure/panch witnesses cited by the prosecution, namely, Santosh Kushwaha and Sakendra Saket, have already been examined by the learned trial Court on 08.07.2026. Both of the aforesaid material witnesses have turned hostile, have completely refused to support the prosecution’s case regarding the alleged recovery, and have admitted that the police forcibly obtained their signatures on blank papers at the police station. She further submits that the applicant is neither the registered owner nor the driver of the seized vehicle, i.e., Tata Ultra Truck bearing Registration No. RJ-19-GJ-7447. As per the contents of the FIR itself, the driver/owner of the said vehicle has been specifically identified as co- accused Raju Singh. There is absolutely no documentary or physical evidence connecting the present applicant with the seized vehicle.
She also submits that the present applicant has no criminal antecedents and he is in jail since 24.06.2025, and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that in the present matter the charge-
3 sheet has been submitted before the competent Court. She further submits that the bail of other co-accused persons, namely, Raju Singh, Mithun Munda and Raj Munda, Uttam Roy have already been rejected by this Court on mertis in MCRC No. 2368 of 2026, MCRC No. 2854 of 2026 and MCRC No. 3437 of 2026 vide orders dated 19.03.2026 and 05.05.2026, therefore, the bail application of the present applicant is also entitled to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, and particularly the fact that the bail applications of the other co-accused persons, namely, Raju Singh, Mithun Munda, Raj Munda and Uttam Roy, have already been rejected on merits by this Court in MCRC No. 2368 of 2026, MCRC No. 2854 of 2026 and MCRC No. 3437 of 2026 vide orders dated 19.03.2026 and 05.05.2026, respectively, no case for grant of bail is made out in favour of the present applicant. Accordingly, the bail application of the present applicant is liable to be rejected. 7. Accordingly, the bail application of the applicant – Dipa Ram, filed under Section 483 of the BNSS, involved in Crime No. 0107/2025 registered at Police Station – Basantpur, District – Balrampur - Ramanujganj (C.G.), for the offence punishable under Sections 15(c), 25 and 29 of the Narcotics Drugs and Psychotropic Substances Act, is rejected. 8.
However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of six months from the receipt of a certified copy of this
order in accordance with law, if there is no legal impediment.
9. Office is directed to send a certified copy of this order to the trial Court
