THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question an order of taking cognizance dated 16.08.2025, passed by the Senior Civil Judge and Chief Judicial Magistrate, Madikere, Kodagu District, in C.C.No.236/2025, for the offences punishable under Sections 314, 316(5) and 318(4) of the BNS. 2. Learned counsel for the petitioner and respondent No.2 would in unison submit that the parties to the lis have - 3 - HC-KAR CNR: KAHC010160322026 NC: 2026:KHC:42116 CRL.P No. 3432 of 2026 entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application under Sections 359 of the BNSS, 2023 along with a joint verifying affidavit before this Court seeking permission to compound the offences. 3. The application reads as follows: “1. The above Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of the proceedings in C.C. No. 236/2025 arising out of Crime No. 93/2024 of Madikere Town Police Station, pending on the file of the Hon'ble Senior Civil Judge and Chief Judicial Magistrate, Madikere. 2. It is submitted that, the Respondent No. 2 had lodged a complaint alleging that while the Petitioner was employed as an Assistant Manager with Respondent No. 2 Company, certain irregularities had occurred in the collection of EMI amounts from customers, pursuant to which Crime No. 93/2024 came to be registered for the offences punishable under Sections 314, 316(5) and 318(4) of the Bharatiya Nyaya Sanhita, 2023, After Investigation, a charge sheet was filed and the matter is presently pending as C.C. No. 236/2025. 3. It is submitted that, during the pendency of the above proceedings, the Petitioner and Respondent No. 2 have amicably resolved all their disputes and differences through mutual discussions. The settlement has been arrived at voluntarily, without any force, coercion, undue influence or misrepresentation. 4. It is submitted that, in terms of the settlement arrived at between the parties, the Petitioner has paid and handed over the entire amount claimed by Respondent No. 2, and Respondent No. 2 hereby acknowledges receipt of the same - 4 - HC-KAR CNR: KAHC010160322026 NC: 2026:KHC:42116 CRL.P No. 3432 of 2026 in full and final settlement of all claims arising out of the subject matter of the present proceedings. 5. Respondent No. 2 further submits that it has no surviving claim or grievance against the Petitioner in relation to the present case and does not wish to prosecute the criminal proceedings any further. Respondent No. 2 has no objection whatsoever if this Hon'ble Court is pleased to quash the FIR, charge sheet and all consequential proceedings pending against the Petitioner. 6. The parties respectfully submit that, in view of the amicable settlement and complete resolution of the dispute, continuation of the criminal proceedings would serve no useful purpose and would amount to an unnecessary continuation of litigation. It is therefore just and expedient that this Hon'ble Court may exercise its jurisdiction and quash the proceedings in order to secure the ends of justice.” In the light of the afore-quoted application and the joint verifying affidavit of the parties, I deem it appropriate to terminate the proceedings against the petitioner, as the dispute and the allegations are between the individuals and not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The order of taking cognizance dated 16.08.2025, passed by the Senior Civil Judge and Chief Judicial - 5 - HC-KAR CNR: KAHC010160322026 NC: 2026:KHC:42116 CRL.P No. 3432 of 2026 Magistrate, Madikere, Kodagu District in C.C.No.236/2025 and all proceedings taken thereto, qua the petitioner, stands quashed.
