Gafoor House opp to Thummala Anuradha house at Bhavani Street, 3rd Cross Road (Vemireddy vari Street) in Ist Ward of Kavali Municipality vide Agreement No.209/2023-23/GGMP, dated 25.11.2023, 2) Construction of CC drain from Makkineni Sulochana house to Pattemsetty Vijaya house at Bhavani Street in 18th Ward of Kavali Municipality vide Agreement No.205/2023-24/GGMP dated 25.11.2023, 3) Providing CC Road from Konduru Srinivasulu house to FCI Godown road in 23rd Ward of Kavali Municipality vide Agreement No.326/2023- 24/GGMP dated 12.02.2024 and 4) Construction of CC drain Meralla Sekhar house to Mungamuri Srinivasulu house at Current office road in 25th Ward of Kavali Municipality vide Agreement No.173/2023-24/GGMP dated 13.11.2023, even after finalizing the bills as illegal arbitrary and contrary to the Principles of natural justice and consequently direct the respondents to pay undisputed bill amounts of 1) Rs.4,95,474/-, 2) Rs.4,94,336/-, 3) Rs.9,81,986/- and 4) Rs.3,95,905/-, payable to the petitioner in respect of execution of afore mentioned works along with interest 18 percent p.a. from the date of recording of bills forthwith and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay undisputed bill amounts of 1) Rs.4,95,474/-, 2) Rs.4,94,336/-, 3) Rs.9,81,985/- & 4) Rs.3,95,905/-, payable to the petitioner in respect of works done i.e., 1) Construction of CC drain from Sk. GP FOR FINANCE PLANNING The Court made the following: 4 Order:- The learned counsel for the petitioner submits that the petitioner was entrusted with four (04) works i.e., 1) Construction of CC drain from Sk. Gafoor House opposite to Thummala Anuradha house at Bhavani Street, 3rd Cross Road (Vemireddy vari Street) in 18th Ward of Kavali Municipality vide Agreement No.209/2023-23/GGMP, dated 25.11.2023, 2) Construction of CC drain from Makkineni Sulochana house to Pattemsetty Vijaya house at Bhavani Street in 18th Ward of Kavali Municipality vide Agreement No.205/2023-24/GGMP dated 25.11.2023, 3) Providing CC Road from Konduru Srinivasulu house to FCI Godown road in 23rd Ward of Kavali Municipality vide Agreement No.326/2023-24/GGMP dated 12.02.2024 and 4) Construction of CC drain Meralla Sekhar house to Mungamuri Srinivasulu house at Current office road in 25th Ward of Kavali Municipality vide Agreement No.173/2023-24/GGMP dated 13.11.2023. 2. It is submitted that the petitioner had completed the works entrusted to her and that the competent authority of the respondents had also approved the payment due and payable to the petitioner. The respondents have also recorded the progress of the works and the amounts due and payable to the petitioner in the M-Book. 3. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Sri Gudapati Laxmi Narayana, learned Standing 5 Counsel for the respondent Nos.2 & 3 and the learned Assistant Government Pleader for Finance and Planning. 4. During the course of hearing, the learned Standing Counsel appearing for the respondent Nos.2 & 3 submits that the works are completed and that the petitioner had also submitted his final bills. 5. Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably within a period of eight (08) weeks from the date of receipt of a copy of this order.
