And In the matter of : Samir Roy. ……Petitioner. Mr. Shibaji Kr. Das Mr. Dipendu Sarkar Ms. Deblina De .....for the Petitioner. Mr. Sandeep Prasad Shaw ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for two years four months and till date out of 32 witnesses proposed by the prosecution 16 witnesses have been examined. Further, similarly placed accused persons have been granted bail. Learned advocate appearing for the State opposes the prayer for bail and submits that the recovered goods were identified in the T.I. Parade. Having considered that the prosecution proposes to examine 16 more witnesses, I am of the opinion that same will consume some more time and the petitioner is in custody for two years four months, as such petitioner be released on bail. Accordingly, prayer for bail of the petitioner is allowed. 2 As such, the petitioner, namely, Samir Roy shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Court. Thus, CRM (M) No. 853 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
