The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.96/2026, registered at Police Station Shivrinarayan, District : Janjgir-Champa (C.G.) for alleged commission of offence punishable under Sections 331(5), 305(a), 310(2), 3(5) of Bhartiya Nagrik Sanhita.

The prosecution case, in brief, is that the case has been registered against the applicant/accused Sanjay Bunkar @ Ravan for committing an offence punishable under the provisions of Sections 305 (A), 331 (5) and 3 (5) of the BNS, 2023, that on 19.03.2026 at 8.00 a.m. at Rahoud SATISH TUMANE Digitally signed by SATISH TUMANE Date: 2026.09.02 11:13:21 +0530
2 Road, Mehndi, Police Station, Shivrinarayan, applicant/accused Sa jay Bunkar @Ravan, Ravi Nirmalkar alias Billu, Shyamji Sinha alias Buti, Priyesh Barman and Karan Dinkar, acting in collusion, in furtherance of a common intention, entered the shop of Sudip Kumar Gupta, Yuvraj Jewellers and Metal, with the intention of causing hurt and committed lurking house trespass and stole two Apple mobile phones and one Samsung phone totaling ₹81,000 were stolen, and the complainant and his wife were assaulted with fists, kicks, and punches. The documents attached to the original record and the accused's memorandum statement indicate that the plan to commit the crime was hatched in his own home with the other accused, and that a recce was conducted to commit the theft at the jewelry shop on March 18, 2026. Hence this anticipatory bail application.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that the applicant has neither participated in the alleged incident nor committed any offence as alleged by the prosecution and omnibus allegations against the applicant, without attributing any specific overt against the present Applicant and the injuries sustained by the injured are simple in nature and no weapon has been attributed to the Applicant. It is further submitted that one of the co-accused, namely, Priyesh Barman has been granted regular bail by this Court vide order dated 23/07/2026 passed in MCRC No.6646 of 2026, therefore, he may be enlarged on anticipatory bail.
4. On the other hand, learned counsel appearing for the respondent/State, opposes the prayer for grant of anticipatory bail to the applicant.

5. I have heard learned counsel for the parties and perused all of the documents taken on record.
6. Considering the facts & circumstances of the case, submission of
learned counsel for the applicant, the nature of allegations, the material available on record and the fact that the FIR contains specific allegations against the present applicant and the nature of injuries sustained by the injured, this Court is of the considered opinion that the applicant has not made out a case for grant of anticipatory bail.

Accordingly, the anticipatory bail application of the applicant -Sanjay Bunkar @ Ravan involved in Crime No.96/2026, registered at Police Station Shivrinarayan, District : Janjgir-Champa (C.G.) for alleged commission of offence punishable under Sections 331(5), 305(a), 310(2), 3(5) of Bhartiya Nagrik Sanhita, is rejected.
