Learned advocate for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. Learned advocate for the State submits that although the parents of the victim implicated the petitioner but drew the attention of the Court to the statement of the victim. I have taken into account the substance of the statement of the victim and is of the opinion that custodial detention of the present petitioner is unwarranted. Thus, prayer for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released subject to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. As the investigation of the case is in progress, the petitioner shall appear within a

period of 10 days before the Investigating Officer and also on all subsequent dates as proposed by the Investigating Officer. Accordingly, the application for anticipatory bail being CRM(A) 801 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
