Learned advocate appearing for the petitioner submits that the subject matter of the case relate to alleged recovery of 125 bottles of Phensedyl Cough Syrup. Petitioner is in custody for about 2 years and 6 months. Majority of the witnesses have been examined but last of the witness was examined on December, 2025 and for more than 7 months no witness has been examined before the learned Trial Court.
Learned advocate for the State opposes the prayer for bail and submits that there are 3 criminal cases against the petitioner. One under the Arms Act and FICN, another under the Arms Act and the other case is under the NDPS Act.

Having considered the overall circumstances of the case including the fact that for the last 7 months no witness has been examined, I direct the learned Trial court to exhaust the prosecution evidence within a period of 2 months and within a period of 2 months thereafter pronounce the verdict. If after the period of 4 months are over, learned Trial Court, in spite of co-operation extended by the petitioner, is unable to reach the stage referred to above, in that case, petitioner be released on bail on such terms and conditions as it deems fit and proper.
At this stage, CRM (NDPS) 1702 of 2026 is dismissed.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
