Vijaya Kumar, learned counsel appearing for the review petitioner, and Sri T. Sheshagiri Rao, learned counsel appearing for respondent Nos. 1 to 5. 2. In this petition, the petitioner has sought for reviewing the order dated 30.08.2024 passed in RSA No. 1516 of 2022. 3. After arguing the matter for some time, Sri K. Vijaya Kumar, learned counsel for the Review Petitioner, submitted that the review petitioner is claiming rights - 4 - HC-KAR CNR: KAHC010561412025 NC: 2026:KHC:40602 RP No. 358 of 2025 over the property in question through his wife, late Smt. Shanthamma. In this regard, he placed reliance upon the proceedings in FDP No. 4 of 2007 pending before the Court of the Civil Judge (Senior Division) and JMFC, Devanahalli. 4. Per contra, Sri T. Sheshagiri Rao, learned counsel appearing for respondent Nos. 1 to 5, submitted that the claim made by the review petitioner is only in respect of such portion of the schedule property as may fall to the share of late Smt. Shanthamma. Therefore, according to him, the claim of the review petitioner is required to be considered under Section 8 of the Hindu Succession Act, 1956. Accordingly, he sought dismissal of the review petition. 5. In the light of the submissions made by the learned counsel appearing for the parties, and upon careful consideration of the material on record, I am of - 5 - HC-KAR CNR: KAHC010561412025 NC: 2026:KHC:40602 RP No. 358 of 2025 the opinion that the review petitioner was deleted from the array of parties by order dated 30.08.2024 passed in I.A. No. 1 of 2024 in RSA No.1516 of 2022. It is the specific case of the review petitioner that he is claiming rights over the property as the husband of late Smt. Shanthamma. 6. In the above circumstances, I am of the considered opinion that no interference is called for with the compromise decree entered into between the parties on 30.08.2024 in R.A. No. 1516 of 2022. However, it is open to the review petitioner to work out his remedy before the competent Court, in accordance with law. Accordingly, the Review Petition stands disposed of.
