Shyamal …for the State 1. Affidavit of service filed on behalf of petitioner is taken on record. 2. By presenting this writ petition, inter alia, petitioner has prayed for direction upon the concerned police authorities to take steps which will permit the petitioner to make construction in terms of sanction plan which is at page 26 of the writ petition. 3. It is submitted that in spite of according sanction plan by the concerned municipality private respondents are preventing the petitioner from making construction which led the petitioner to lodge complaint before the 2 concerned police authorities seeking help. However, it is alleged that police authority has not extended help. 4. Learned advocate representing respondent nos. 6 to 9 has opposed this writ petition and it is submitted that petitioner is trying to make construction violating sanction plan thereby encroaching adjacent road as a result whereof petitioner was prevented from making construction. 5. State respondents are represented by learned advocate who has submitted on instruction that police authorities are trying to keep peace at the locale on receiving complaint from petitioner. 6. From the case made out in this writ petition it appears that petitioner has obtained sanction plan based on which petitioner tried to make construction but was prevented by private respondents on the plea that construction encroaches adjacent road. 7. If petitioner is having valid sanction plan issued by concerned municipality in that event construction being carried out by the petitioner ought not to be obstructed. 8. The petitioner is directed to appear before the Officer-in-Charge, Ghatal Police Station, 3 Paschim Medinipur by 18th August, 2026 and produce sanction plan. 9. If police authority finds that valid sanction plant is issued to the petitioner in that event assistance shall be provided to the petitioner for making construction strictly in terms of such sanction plan till sanction plan survives. 10. With the aforesaid directions writ petition stands disposed of. 11. Parties to act on the server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
